Welcome to Book An Estimate LLC (“BookAnEstimate,” “we,” “us,” or “our”). These Terms of Service govern your access to and use of BookAnEstimate.com and our estimate-request, provider-matching, communication, and support services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. What BookAnEstimate Provides

BookAnEstimate helps homeowners and businesses describe a project, request an on-site estimate, and connect with an independent local service professional who may be suited to the requested work. We may help route project information, coordinate preferred estimate timing, and facilitate communications.

BookAnEstimate is not the contractor or service professional performing the requested work unless we expressly agree otherwise in writing. We do not perform construction, repair, maintenance, inspection, diagnosis, or other trade services through the website. Service professionals are independent businesses and are not our employees, agents, partners, or representatives.

3. Eligibility

You must be at least 18 years old and legally capable of entering a binding agreement to use the Services. By using the Services, you represent and warrant that you meet these requirements. If you use the Services for a business or other organization, you represent that you are authorized to bind that organization.

4. Estimate Requests and Scheduling

You agree to provide accurate, current, and reasonably complete information about your identity, property, project, location, access requirements, and preferred timing. You are responsible for updating information that changes and for confirming project details directly with the service professional.

A submitted request is not a confirmed appointment, contract, quote, or guarantee of service. Dates and times entered through the website are preferences only until confirmed. An on-site estimate may change based on conditions observed at the property, additional information, material or labor requirements, permits, accessibility, or other factors. Any agreement for paid work is between you and the applicable service professional unless BookAnEstimate expressly states otherwise in writing.

You authorize us to contact you and to share information reasonably necessary to respond to your request with service professionals and operational service providers, as described in our Privacy Policy.

5. Independent Service Professionals

We seek to connect visitors with trusted local professionals based on available information, including service category, location, scheduling needs, credentials, and customer ratings. References to “certified,” “5-star,” “trusted,” or similar qualifications describe our matching standards or available third-party information and do not create a warranty or guarantee regarding a particular professional or outcome.

You are responsible for evaluating a service professional before authorizing work, including reviewing the proposed scope, price, contract, insurance, licensing, permits, warranties, and other terms. Availability, credentials, ratings, pricing, workmanship, communications, and project outcomes are controlled by the independent professional and may change. BookAnEstimate does not guarantee that a professional will accept a request, arrive at a particular time, provide a particular price, or complete work to a particular standard.

6. Acceptable Use

You agree to use the website and Services only for lawful purposes and in a manner that does not infringe the rights of, harm, threaten, deceive, impersonate, or restrict any other person. You may not:

• Submit false, fraudulent, misleading, abusive, discriminatory, or unlawful requests;
• Attempt to gain unauthorized access to the website, accounts, systems, or data;
• Introduce malware, scrape or harvest information, overload the website, or interfere with its operation;
• Use automated means to submit requests without our written permission; or
• Use content from the Services to build a competing database, directory, or service.

We may suspend, reject, or terminate requests or access when we reasonably believe these Terms have been violated or use creates risk for us, a service professional, or another person.

7. Emergencies and Site Safety

The Services are not an emergency-response, diagnostic, engineering, medical, utility, or life-safety service. Do not rely on the website for an active fire, gas odor, electrical hazard, flooding, structural collapse risk, crime, medical emergency, or other immediate danger. Leave unsafe areas and contact 911, the appropriate utility, or another qualified emergency resource.

You are responsible for providing safe, lawful access to the property and disclosing known hazards, animals, access restrictions, occupancy conditions, and other information that may affect an estimate visit.

8. Text Messaging (SMS) Terms

When you affirmatively opt in to our SMS program, you agree to receive text messages from Book An Estimate LLC at the mobile number you provide. Messages may include customer support, estimate coordination, appointment or service updates, and marketing communications described at the point of consent.

• Consent: SMS consent is not a condition of purchase.
• Message frequency: Message frequency varies based on your interactions and requests.
• Message and data rates: Standard message and data rates may apply.
• Opt out: Reply STOP at any time to unsubscribe. We may send one final message confirming your opt-out.
• Help: Reply HELP for support information or use our contact form.
• Delivery: Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and network and is not guaranteed.

9. Email and Electronic Communications

By using the Services, you agree that we may communicate electronically regarding your requests, transactions, support inquiries, these Terms, and legally required notices. You may unsubscribe from marketing emails using the link in the message, but we may continue sending non-marketing communications related to active requests, security, or legal obligations.

10. Intellectual Property

The website, branding, software, design, text, graphics, and other content provided by BookAnEstimate are owned by or licensed to us and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to use the website for personal or internal business purposes. No other rights are granted.

You retain ownership of content you submit. You grant us a nonexclusive license to host, process, reproduce, transmit, and share that content as reasonably necessary to operate the Services, fulfill your requests, improve functionality, protect the Services, and comply with law.

11. Third-Party Services and Links

The website may rely on or link to third-party services, including service professionals, communications platforms, analytics tools, maps, videos, and other websites. We do not control and are not responsible for third-party content, availability, security, terms, privacy practices, products, or services. Your interactions with a third party are governed by your agreement with that party.

12. Disclaimers

To the fullest extent permitted by law, the website and Services are provided “as is” and “as available.” We disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and results. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any service professional, estimate, project, or communication will meet your expectations.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, BookAnEstimate and its owners, officers, employees, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, goodwill, or business opportunity; property damage; personal injury; or claims arising from an independent service professional’s acts, omissions, estimates, advice, communications, workmanship, delays, or failure to perform.

To the fullest extent permitted by law, our aggregate liability arising from or related to the Services will not exceed the greater of the amount you paid directly to BookAnEstimate for the applicable Services during the six months before the event giving rise to the claim or one hundred U.S. dollars ($100). Nothing in these Terms excludes liability that cannot lawfully be excluded.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless BookAnEstimate and its owners, officers, employees, agents, and affiliates from claims, liabilities, damages, judgments, losses, and expenses, including reasonable legal fees, arising from your unlawful or improper use of the Services, your submitted content, your violation of these Terms, or your infringement of another person’s rights.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and make a good-faith effort to resolve the dispute informally. Unless applicable law requires otherwise, legal proceedings arising from these Terms or the Services will be brought in the state or federal courts serving Rock Island County, Illinois, and you consent to their jurisdiction and venue.

16. Changes to the Services or Terms

We may modify, suspend, or discontinue any part of the Services and may update these Terms from time to time. Updated Terms become effective when posted unless a later date is stated. Your continued use after the effective date constitutes acceptance of the updated Terms.

17. General Terms

If any provision is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent; we may assign them in connection with our business. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Services unless another written agreement expressly applies.
